TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYTEVIBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM OR RELATING TO YOUR USE OF THE PLATFORM.
11.4 No Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless nYtevibe and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your violation of any third-party rights
13. DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
